Abstract

Rowan Williams, the Archbishop of Canterbury, introduced the idea of incorporating aspects of Sharia law into the English legal system. This paper, therefore, explores the possibility of English family law benefiting from transplanting some aspects of Sharia into its own, particularly the incorporation of a no-fault divorce. It will examine whether implementing a no-fault divorce system into the UK would be more reflective of the current social and practical reality of marriage breakdowns, and whether this implementation can encourage a positive approach towards divorce.
