Abstract | Opinions of Advocates General frequently remain in the shadow of judgments of the Court of Justice. While undeniably it is true that the Court has the final word, it is impossible to deny that the reasoning of the judges is very influenced, if not shaped, by conclusions of Advocates General through the Opinions (or Views) which they deliver. There are numerous cases where the Opinions of Advocates General have enriched the discourse on various aspects of EU law, and triggered extensive academic debate, yet fell short of inspiring the judges in the case at hand. Unquestionably, the Advocates General are a part of Court’s DNA, even though the modern era sees their assistance in just approximately 50% of all cases occupying the Court’s docket. This chapter looks at the genesis and the role of AGs. |
