Abstract | Through an analysis of the two core provisions of the ATT – Articles 6 and 7 – this article explores their interaction with the customary norms on foreign intervention in situations of internal unrest, namely the principles of non-intervention and of internal self-determination and the prohibition of the use of force. After delineating both the treaty and the customary regimes, this article compares them and identifies potential conflicts. It also explores how these conflicts can be reconciled and how the two regimes can reinforce each other. |
